In addition, failure to enforce a final judgment or to review it contradicts the principle of the rule of law , e of legal certainty; the court, as a general rule, should not take into account a party's reference in substantiating its position to factual circumstances that arose as a result of the party's failure to enforce a final judgment.

A similar conclusion was formulated by the Supreme Court, in particular, in the resolutions of October 18, 2018 in case No. 638/643/17, April 18, 2019 in case No. 808/2291/16, November 21, 2019 in case No. 344/8720/16-а, November 29, 2019 in case No. 805/5043/15-а, February 20, 2020 in case No. 15/6834/15, February 18, 2022 in case No. 520/3601/19, and June 1, 2022 in case No. 640/25836/20.

According to the provisions of Part One of Article 1 of the Law of Ukraine "On Enforcement special database Proceedings" dated June 2, 2016 No. 1404-VIII (hereinafter referred to as Law No. 1404-VIII), enforcement proceedings, as the final stage of judicial proceedings, and the enforcement of decisions of other bodies (officials) are a set of actions of bodies and officials defined in this Law, aimed at the enforcement of decisions of courts and other bodies (officials), which are carried out on the grounds, within the limits of their powers and in the manner determined by this Law, other regulatory legal acts adopted in accordance with this Law and other laws, as well as decisions that are subject to enforcement in accordance with this Law.

Part one of Article 11 of Law No. 1404-VIII states that the state bailiff is obliged to take measures of compulsory execution of decisions provided for by this Law, to carry out enforcement actions impartially, promptly and in full.
