The trademark is a distinctive sign that allows us to identify the products or services that a brand offers, to distinguish them from those of other competing companies.
In other words, a trademark is a word, a person's name, a design, a letter, a sound, or a combination of colors.
Without it, a business risks not being recognized by its consumers and remaining in the dark in a closed box.
That's why every company has to create one and then register it!
Legislative Decree no. 30 of 10 February 2005 (Industrial self employed data Property Code) and subsequent legislative amendments allow the applicant to register a trademark provided that it meets certain fundamental requirements.
Two purely FORMAL:
Lawfulness : The trademark cannot contain signs that are contrary to the law, public order, morality or signs that are already protected by international conventions.
Truth: The trademark must not deceive the end user about the geographical origin, nature, quality of the products and services offered.
